Please read these terms and conditions ("Terms") carefully before using the www.petsit.com website (“the Website ") operated by Pet Sitters International, Inc. (“PSI”).

Conditions of use

By using the Website, you certify that you have read and reviewed this Agreement and that you agree to comply with these Terms. If you do not want to be bound by the Terms of this Agreement,do not use the Website. PSI only grants access to this website and the products and services offered to those who have accepted these Terms.

Changes

We may change these Terms at any time, for any reason at our sole discretion and without notice.  The current Terms will always be available through the Website.  If you continue to use the Website after the effective date of a change to the Terms, that means you have accepted and agree to the changed Terms.  If you object to any of the changes, then your sole recourse is to stop using the Website. 

Privacy policy

Before you continue using the Website, we advise you to read our privacy policy regarding our user data collection. It will help you better understand our practices. By agreeing to these Terms, you also agree to the Privacy Policy.

Age restriction

You must be at least 18 (eighteen) years of age before you can use the Website. Use by minors is strictly prohibited. By using the Website, you warrant that you are at least 18 years of age. PSI does not willingly or knowingly collect personal information from a minor, and assumes no responsibility for liability resulting from age misrepresentation.

Intellectual property

All trademarks, service marks, trade dress, logos, copyrights, design rights, trade secrets, rights to databases and compilations, and other intellectual property rights in and to the Website and the materials displayed on or offered through the Website (“IP”) are owned by PSI or by third parties.  You agree not to copy, download, distribute, make derivate works, or make any unauthorized commercial use of the IP displayed on the Website. You also agree not to attempt to hack, reverse engineer, decompile, or disassemble the Website software or otherwise attempt to change its functionality or derive its source code, except where expressly permitted by law.  Your use of the Website does not grant you any licenses or rights in or to any IP displayed on the Website. 

You grant PSI a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast any content you upload and publish to the Website.

User accounts

As a user of this website, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.

You agree that your account and password are personal to you. You may not use anyone else's account at any time and you may not allow anyone else to use your account at any time.  If you have reason to believe that your account is no longer secure, you must: (i) promptly change your password, and (ii) inform us immediately by email to info@petsit.com.

We reserve all right to terminate accounts, edit or remove content and cancel orders at our sole discretion.

Applicable law and dispute resolution

By using the Website, you agree that the laws of North Carolina, without regard to principles of conflict of laws, will govern these Terms and any dispute arising out of or related in any way to your use of the Website or products or services offered through the Website. Any such dispute will be resolved by friendly negotiation if possible. Otherwise, any claim based on such a dispute may be brought exclusively in the federal or state courts sitting in or having jurisdiction over Forsyth County, North Carolina, and you and we consent to exclusive jurisdiction and venue of such courts.

Indemnification by You

To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless PSI and its officers, owners, employees and agents, from and against all claims, actions, liabilities, damages and expenses (including court costs, legal fees, and amounts paid in settlement) by any third party arising out of or relating to (a) any actual or alleged violation of these Terms by you; (b) any allegation that any materials you submit to us or transmit to the Website infringe or otherwise violate the copyright, patent, trademark, trade secret, or other intellectual property or other rights of any third party; and/or (c) your negligent or willful misconduct.  You will cooperate as fully as reasonably required in the defense of any such claim or action; however, we reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.

Limitation of Warranties and Remedies

THE FOLLOWING TERMS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW:

The Website is provided to you “as is.”  We make no promises that the Website is accurate, complete, reliable, current, secure, or error-free; that it will operate or be accessible without interruption; or that the Website will be free from viruses or other harmful components.  You use the Website at your own risk.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND, TO THE FULLEST EXTENT PERMITTED UNDER THE LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.  SOME STATES DO NOT ALLOW DISCLAIMER OF WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU. 

Reprints, Licensing & Permissions Policy

The content in all PSI publications displayed on or offered through the Website is copyrighted, and may be, copied, reposted, or reprinted by permission only. In some cases, a fee will be required. Any reprint, licensing, or permission requests to use any PSI publications and/or materials on Website must be submitted in writing to info@petsit.com. 

You may link to any of our Website pages or articles without charge and without advance permission, so long as the link is not deceptive or misleading and accurately informs users that they are being redirected to the Website.

Due to privacy concerns, Pet Sitters International (PSI) does not provide information on members other than what is listed for public display on our Locator. PSI does not provide mailing lists of its members for any purpose. Solicitation of members through the PSI Locator for the sale of goods and services is prohibited.

PSI is an educational organization and does not inspect or police member businesses. Our Locator information is provided solely as a courtesy to help pet owners identify pet sitters in their area, and PSI assumes no liability in connection with any information listed. 

PSI does not endorse any individuals or companies listed on the Locator.
